By submitting media for digitization, the customer acknowledges and agrees to the following:
1. The customer certifies that they own the submitted media or have permission to reproduce its contents. Commercial television shows and movies will not be digitized.
2. Mixed-content tapes: If a tape contains both personal home videos and commercial copyrighted recordings, only the home video portions will be digitized. Multiple digital files may be created when personal recordings are separated by copyrighted content.
3. Unknown Tape Contents: If it is unknown whether the tape contains recordable content, an option exists for a quick inspection for a lower fee. Brief portions of the tape are inspected from start to finish to identify its contents. If personal content is found, the tape is thoroughly inspected and standard digitization rates apply. With a quick inspection there is no guarantee that all personal content will be found. Thorough inspections are offered for standard digitization rates including extended length fees when applicable.
4. Magnetic tapes, DVDs, and other media naturally deteriorate with age. Playback issues, image degradation, audio problems, mold, tape damage, or complete loss of content may exist before processing begins.
5. Magnolia Memory Co. will make every reasonable effort to safely digitize submitted media but cannot guarantee the recovery of all recordings.
6. Magnolia Memory Co. is not responsible for damage caused by age, deterioration, manufacturing defects, prior storage conditions, or existing media defects.
7. While Magnolia Memory Co. uses equipment maintained in good working order and exercises reasonable care in handling customer media, the digitization process requires playback of aging tapes and other media formats. Due to the condition and age of these materials, there is a risk that media may become damaged, jam, break, or otherwise fail during playback. Magnolia Memory Co. is not liable for damage resulting from the normal digitization process, media deterioration, or equipment malfunction beyond reasonable control.
8. Completed digital files should be backed up by the customer. Magnolia Memory Co. is not responsible for future file loss after delivery.
9. Magnolia Memory Co. will retain completed digital files for up to thirty (30) days following delivery to the customer. After that time, files may be permanently deleted without notice. Customers are responsible for backing up and safeguarding their digital files upon receipt. Magnolia Memory Co. is not responsible for lost files after delivery or after the 30-day retention period has expired.
10. Original media will be returned to the customer unless otherwise requested.
11. Orders not claimed within ninety (90) days of completion may be considered abandoned. Magnolia Memory Co. reserves the right to dispose of abandoned media and materials after reasonable efforts to contact the customer.
12. Payment is due upon completion unless other arrangements have been made.
SERVICE LIMITATIONS
Magnolia Memory Co. is a small, home-based digitization service focused on preserving family memories in an affordable and accessible manner. Services are performed using carefully maintained consumer and prosumer-grade equipment rather than specialized archival restoration systems.
While every reasonable effort is made to produce the best possible digital copy, the quality of the final video is limited by the condition of the original recording, the age of the media, and the capabilities of the source format. Magnolia Memory Co. does not guarantee professional restoration, enhancement, repair of damaged footage, or broadcast-quality results.
